Entities Covered: HorrorXSciFi.com ("HSF"), owned by FilmPod Corp and all associated entities, companies, agents, contractors and third parties (collectively, the "Company," "we," "us," or "our").

1. Service Provider Status
HSF is an online service provider under 17 U.S.C. § 512(c). HSF hosts and provides streaming infrastructure for independent filmmakers ("Content Providers"). Content Providers retain control over their submitted content and act as the publishers/streamers of their material. The Company does not pre-screen, select, or modify user-uploaded videos prior to publication.

2. Designated Copyright Agent
All notifications of claimed copyright infringement must be sent to our Designated Copyright Agent:

3. Requirements for a Valid DMCA Notice (§ 512(c)(3))
To ensure a fair process and prevent bad-faith or automated claims, HSF requires strict compliance with 17 U.S.C. § 512(c)(3)(A). Incomplete or non-compliant notices will not be processed or acted upon.

To be effective, a notification of claimed infringement must be a written communication sent to our Designated Agent that includes substantially the following:

  1.  Physical Signature: A physical (handwritten) signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. (Scanned PDF submissions containing a genuine handwritten signature sent via email are accepted).
  2. Identification of Copyrighted Work: Specific identification of the copyrighted work claimed to have been infringed, including copy of registration certificate(s) issued by the U.S. Copyright Office (or relevant foreign equivalent) where available.
  3. Identification of Infringing Material: Specific identification of the material claimed to be infringing, including:
    The exact URL(s) on horrorxscifi.com.
  4. Declaration of AI / Technical Context (Where Applicable): If the claim involves allegations surrounding AI-generated imagery, script, audio, or synthetic media, the notice must explicitly detail the legal basis under current U.S. Copyright Office guidelines explaining why the claimed work possesses valid copyright protection or how the specific underlying element infringes actionable exclusive rights.
  5. Statement Under Penalty of Perjury: A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

4. Review, Ambiguity, and Dispute Protocol
Upon receipt of a Notice that strictly complies with Section 3:

  1. Compliant Notices: The Company will expeditiously remove or disable access to the specified material and notify the affected Content Provider.
     
  2. Non-Compliant or Ambiguous Notices: If a notice fails to contain the statutory elements, contains vague/unsubstantiated claims (including broad, generalized allegations regarding AI tools), or presents ambiguous factual/legal disputes requiring judicial interpretation, the Company reserves the right to notify the claimant of the deficiency without removing content.
     
  3. Neutral Platform Boundary: The Company is not a court of law and will not adjudicate complex ownership disputes, contract disputes between filmmakers and third parties, or unverified assertions regarding copyrightability. In cases of legal ambiguity, content will remain active pending an order from a court of competent jurisdiction or a compliant statutory notice.

5. Counter-Notification Procedure (§ 512(g))
If a Content Provider believes their material was removed by mistake or misidentification, they may submit a Counter-Notification to our Designated Agent containing:

  1. Physical or electronic signature of the Content Provider.
     
  2. Identification of the material removed and the location before removal.
     
  3. A statement under penalty of perjury that the provider has a good faith belief the material was removed or disabled as a result of mistake or misidentification.
     
  4. Content Provider’s name, address, phone number, and consent to federal court jurisdiction.

Upon receipt of a valid Counter-Notification, HSF will forward it to the original claimant. If the original claimant does not file a court action seeking a restraining order within 10 to 14 business days, HSF will restore the removed material.

6. Statutory Misrepresentation Warning (§ 512(f))
UNDER 17 U.S.C. § 512(f), ANY PERSON WHO KNOWINGLY MATERIALLY MISREPRESENTS THAT MATERIAL OR ACTIVITY IS INFRINGING MAY BE SUBJECT TO LIABILITY FOR MONETARY DAMAGES, INCLUDING COSTS AND ATTORNEY'S FEES INCURRED BY HSF, FILMPOD CORP, OR THE AFFECTED CREATOR.  

7. Repeat Infringer Policy (§ 512(i))
In accordance with § 512(i), HSF will terminate, in appropriate circumstances, the account access of Content Providers determined to be repeat infringers.

If you believe content hosted on HorrorXSciFi.com infringes your copyright, follow these steps:

  3. If your claim involves AI-generated content, verify that the subject matter meets current statutory criteria for copyright protection.

Step C: Complete Required Fields
Accurately fill out every section of the form, ensuring you include:

  1. Full contact details.
     
  2. Registration details or proof of ownership.
     
  3. Exact HSF URLs and precise timestamp start/stop markers.

Step D: Sign by Hand (Wet Signature)
PRINT the completed form and physically sign it by hand in ink, under penalty or perjury. Electronic text signatures (e.g., /s/ John Doe, images, typed or unverified web-form submissions) do not meet our formal verification standards for notice processing. Forms without physical signatures will not be processed or considered.

Step E: Scan and Submit
